PIERRE, S.D. (KOTA TV) – A petition to require transgender people to use public school facilities based upon their biological sex at birth can now be circulated.
That comes after South Dakota Attorney General Marty Jackley approved the explanation for the proposed initiated measure.
The measure is entitled “An initiated measure requiring people to use certain rooms designated for the same biological sex.”
In the AG’s explanation (click here for the full text), it is stated that the measure applies to the use of public elementary and secondary school locker rooms, shower rooms, restrooms and changing facilities; and that “biological sex” means a person’s sex at birth.
If 13,871 valid signatures are gathered by Nov. 6, the measure will be placed on the November 2018 general election ballot.
