CBD is derived from the hemp plant and is not legal in South Dakota. Police even raided two Rapid City stores with the products in Septemeber.
Noem says hemp and CBD oil will ultimately lead to the legalization of marijuana.
Governor Noem said, "I have said that if the FDA regulates it and we know what is actually in the product we would consider it, but today when CBD oil is on the shelf, no one has checked it, it has not been inspected, we do not know how much THC is in the product."
