High court: No new rape trial for Rapid City man

PIERRE, S.D. (AP) - The South Dakota Supreme Court says a Rapid City man sentenced to life in prison for raping a child is not entitled to a new trial.

John Rolfe was convicted in 2011 on three counts of first-degree rape and 12 counts of possession of child pornography.

In Rolfe's first appeal, the Supreme Court determined Circuit Judge Thomas Trimble improperly closed the trial to the public when the victim testified because he didn't properly support the closure on the record. The court remanded it so he could do that.

Rolfe appealed that decision and also asked for a new trial, which Trimble denied.

In a response to that second appeal filed Thursday, justices concluded Rolfe was not entitled to another trial and Trimble properly supported his decision to close the trial.
