Spearfish ROTC sergeant pleads not guilty to rape charge

A sergeant in the ROTC program at Black Hills State University in Spearfish was arraigned Tuesday on rape and other charges. Cesar Olaso entered a not guilty plea to forcible rape and providing alcohol to a trainee who was older than 18 but younger than 21.

In a Lawrence County courtroom Tuesday morning, prosecutors said they are waiting on results of a DNA analysis of the sexual assault kit.
The judge put a Aug. 19 deadline for discovery, which includes lab results.

Olaso faces 25 years in prison for the rape charge and 30 days in jail for providing alcohol to the person younger than 21. The next hearing is scheduled for Aug. 26.  Prosecutors say at that time a trial date probably will be set.
