Skye Burnham-Endicott, 27, faces a possible life sentence for the alleged kidnapping of his children and the assault of their mother.
On Tuesday, the defense questioned their witness, a casino employee, who spoke about an incident that happened last June where he says the mother hit Burnham-Endicott. Surveillance video was shown to prove it.
The state wanted the mother to testify, but they have been unable to contact her. So the judge ordered a material witness warrant.
Other witnesses will testify Aug. 22. The three day trial is set to start Sept. 9.
