Rapid City police officer cleared in June shooting

The Rapid City police officer who shot and killed a man has been cleared after the state's Division of Criminal Investigation looked into the June 4 shooting.

Officer Jerrell Lewellen shot Harold Murphy while Murphy was struggling with another officer, Luke Lang.  Lewellen had made a traffic stop on Murphy, who was riding an ATV on West Main Street.  Murphy took off with Lang in pursuit.  During the struggle, police say Murphy pulled out a gun and started firing.

The report states that 10 shots were fired, six by Murphy and four by Lewellen.  All four of Lewellen's rounds hit Murphy.  Lang did not fire his weapon.

“It is the conclusion of this report and the Attorney General that Officer Jerrell Lewellen was justified in firing his weapon and using lethal force,” Attorney General Marty Jackley said.

Murphy has 1.3 ounces of methamphetamine, four grams of heroin, eight grams of mushrooms and $7,410 in cash on him. 

Toxicology results showed that Murphy has drugs in his system but his blood alcohol content was .000.  Drug and alcohol screenings on both officers were negative.
