Attorney plans to prove city is to blame for Spearfish sewer saga


The Spearfish sewer saga continues.

Private Attorney John Fitzgerald says he's is trying to figure out what caused raw sewage to back-up in basements, washing machines, and water heaters in the homes of some residents in Spearfish.

It happened when the snow began to melt after the October blizzard.

In December, homeowners filed a lawsuit against the city complaining of sewage problems.

Tom Brady, city attorney, maintains the city is not responsible for the smelly situation.

Fitzgerald says he suspects a storm drain is adding water to the sewage line and he plans to prove it "Just be pumping a bunch of dye down the storm, and we'll have someone at Eighth Street and if we see pink, then we know there's a least one leak," said Fitzgerald.

Brady says Fitzgerald is "grabbing at ghosts."
