Judge denies request to modify Rapid City man's lengthy sentence


In September 2012, John Shaw started a small riot in a Pennington County courtroom after being sentenced to 60 years behind bars.   Monday morning, at a review hearing, Shaw, now 21,  appeared before Seventh Circuit Judge Janine Kern hoping for another modification to his 30 year sentence.

Judge Kern originally sentenced  Shaw to 60 years behind bars for discharging a firearm at a motor vehicle, aggravated assault, and possession of a loaded firearm while intoxicated. It was later modified to a 30 year sentence.

Judge Kern did not make any changes to his sentence Monday, noting that he is not taking responsibility for the entire ordeal.

Judge Kern has jurisdiction over his case until September.  She says she rarely schedules review hearings, but did so in Shaw's case because of his young age and lengthy prison sentence.
He'll have another review hearing in September.
