Child porn evidence in Rapid City case to be examined by defense expert

The defense attorney for a convicted sex offender, who is now charged with possessing child pornography, wants a privately detained defense expert to examine evidence in the case. 

Attorney Jay Davis asked the court to allow the defendant, James Holtry's computer to be re-examined by the expert in a lab in at the U.S. Attorney's office in Sioux Falls.  The state didn't object.  Judge Robert Gusinsky did grant Davis' request.

It's alleged that Holtry was looking at child pornography at the McDonalds on East North Street last August.  One witness told police that he was making faces and interacting with children who were playing at the play land housed there.


Designated defense experts are only allowed to view child pornography at a lab at the U.S. Attorney's Office in Sioux Falls.  Viewing it anywhere else is illegal.
