Lawmakers reject abortion ban for Down syndrome

Posted:

PIERRE, S.D. (AP) _ A South Dakota legislative panel has rejected a measure that would have prohibited abortions sought because a fetus has been diagnosed with Down syndrome.

The House Health and Human Services Committee rejected the bill after lawmakers said it could jeopardize the state's legal defense of other abortion restrictions passed in previous years.

The bill would have made it a misdemeanor for a doctor to perform or attempt an abortion if a woman sought to end a pregnancy because the fetus has or may have Down syndrome, a genetic disorder.

The measure is similar to another bill that passed the House on Wednesday. That other bill would ban abortions sought because of the gender of a fetus, but lawmakers have not said that measure would interfere with existing court cases.
