Statewide texting ban clears first hurdle


South Dakota is one step closer to a ban on texting while driving.   

In a unanimous vote Monday morning, the House Judiciary Committee passed House Bill 1177, which would make texting while driving a secondary offense, carrying a $25 fine.

House Speaker Brian Gosch of Rapid City initially introduced a bill that sought to prevent local governments from passing and enforcing their own distracting driving ordinances. But at a committee hearing last week, he changed the bill to ban texting while driving statewide.

If the bill becomes law, it would also make any existing city ordinances that deal with texting and driving worthless.
