Another sexual orientation bill surfaces in South Dakota Legislature


While two South Dakota legislative bills to shield those who shun same-sex marriage ceremonies fade, another bill surfaces to keep the debate alive. 

Senator Phil Jensen (R-District 33) and Representative Chip Campbell (R-District 35) are the main sponsors of Senate Bill 128 which could prove to be more controversial than the previous attempts.

Using the free speech argument, the bill goes further than the issue of marriage, protecting people who just don't want someone in their business because of their sexual orientation. 

Also in the proposed bill is a provision that requires punitive damages against anyone who files a discrimination lawsuit and, if asked, requires the state's attorney general to defend the person or business being sued.

The bill hasn't been assigned to a committee yet.
