Judge says computer can be used as evidence in child porn case

Judge Robert Gusinsky denied a request to suppress any evidence found on the computer of James Holtry, 51, who is a registered sex offender.  Holtry is charged with possessing child pornography. His attorney, Jay Davis, argued that the responding police officers did not have probable cause to take the computer.


According to police, Holtry was acting suspicious during his interactions with children at the East North Street McDonalds in Rapid City in August.  One witness claims that he was looking at pictures of young girls.  After further investigation, police say they found a picture of a nude young girl on a site called benaughty.com.
