City of Spearfish responds to complaint because of sewer problems


The city of Spearfish is denying every complaint filed against the city regarding sewer problems that caused raw sewage to back-up in basements, washing machines, and water heaters.   

Fourteen people are listed on a complaint that alleges the city was negligent in the way it treated drainage from snow melt from the October blizzard.

The city's response also denies responsibility for prior problems that are alleged in June of 2008.

The city is asking that the complaint be dismissed.

Meantime, city officials are trying to determine why the water infiltrated the waterline. In December, water was diverted from a line that caused the backups.  

Private practice attorney, John M. Fitzgerald says the plaintiffs are calculating damage costs and gathering expert opinion. The next step will be to see if a settlement can be reached.
