A Pennington County jury convicted a man of attempted fetal homicide in September. On Monday, Alfredo Vargas was sentenced to five years in prison.
Vargas, 36, was found guilty of trying to make his ex–girlfriend have a miscarriage by spiking her soda with labor inducing drugs.
On Monday, Vargas' family including his daughter and stepson, crowded the court room to hear the sentencing. Prosecutors say he committed a heinous crime and hasn't owned up to it. Defense attorneys say he is a caring man and is not a danger to society.
Before she sentenced him, Seventh Circuit Judge Janine Kern says Vargas shows no remorse for his actions.
There will be a hearing on Thursday to go over court costs. After that, defense attorney Jamy Patterson says she plans to appeal the verdict.
