Rapid City judge to decide if smoking ban applies to hookah lounge

In the last day of the hookah trial, a chemist testified that what is exhaled from a hookah is smoke.

Ifrits Hookah Lounge owners claim the vapor that comes from a hookah pipe is different than what comes from a cigar or cigarette, and therefore the state-wide smoking ban does not apply to them.

Rapid City attorneys argue that hookah vapor has the same chemical compounds found in cigars and cigarettes.

South Dakota law prohibits the use of burning or carrying a lit tobacco product into businesses. Right now, Ifrits is allowed to stay in business because it is classified as a tobacco business. State law says tobacco establishments cannot sell alcohol. 

Seventh Circuit Judge Jeff Davis will make a decision after the attorneys submit their findings in two weeks.

Is hookah vapor similar to smoke from a cigarette or cigar?  That's the question a KOTA Territory judge will answer this week.

South Dakota law prohibits the use of burning or carrying a lit tobacco product into businesses.  Hookah owners say the vapor that comes from a hookah pipe is different than what comes from a cigar or cigarette, and therefore the state-wide smoking ban does not apply to them.  City attorneys argue that hookah vapor has the same chemical compounds found in cigars and cigarettes.

If Presiding Judge Jeff Davis decides hookah vapor is not dangerous and completely dissimilar to smoking, the business would be able to again sell alcohol.

Right now, Ifrits is allowed to stay in business because it is classified as a tobacco business. State law says tobacco establishments cannot sell alcohol. The business was stripped of its alcohol licenses last spring.

The trial is expected to last two days.
