Ex South Dakota legislator and convicted rapist files lawsuit against the state


A former state legislator convicted of rape has filed a lawsuit in federal court against the state of South Dakota.

Ted Klaudt is requesting the court to remove an unaccepted action he attempted to file in August.

That action was a "Motion to vacate opinion" based on a perceived bias and retaliation from former social & business relationship with justices on the court.

Klaudt was found guilty in 2007 and sentenced to 44 years in prison on 2nd degree rape charges and another 10 years for witness tampering for an incident involving inappropriate sexual contact with a teenage foster daughter.

This is one of many lawsuits Klaudt has filed attempting to nullify his imprisonment.

The state of South Dakota has not issued its response to the lawsuit.
