Witness says Birds Head had options other than lethal force

A defense witness in the Charles Birds Head manslaughter case says Birds Head unnecessarily shot and killed his friend. 

Defense witness Frank Milk testified Friday morning that Eustacio Maruffo started the fight. The defense' theory is that Milk and Maruffo lured Birds Head to the South Dakota Rose Motel to assault him. Milk denies that. He says Birds Head was coming to the motel to pick up a 15-year-old girl.  According to Milk, Maruffo didn't like that idea so he confronted Birds Head and a fight ensued.

The lead detective in the case, Steve Neavill, said on the stand earlier this week, that he believes Birds Head had the option to drive away.
