A 33–year-old Rapid City man charged with possessing child pornography was denied a sentencing modification in court Tuesday.
Warren Apple was requesting a suspended imposition in order to seal his records following completion of his probation. But Judge Wally Eklund denied the motion stating that he would like to monitor Apple's probation for longer period of time.
Apple will be allowed to request the modification further down the road.
As part of his sentence, Apple is prohibited to have unsupervised contact with anyone under 18-years-old. And, during his first year of probation, he will not be allowed to use the Internet.
