Trial date set for man accused of fetal homicide


A trial date is set for a man accused of trying to kill his unborn child.

35 year old Alfredo Vargas (who made his court appearance via telephone from Glendive, Montana) will face a jury September 18th through the 20th.

Before then, 7th Circuit Judge Janine Kern set an evidentiary hearing to decide whether to suppress some evidence, specifically lab work on a soda can, that the defense claims was mishandled.

State prosecutors allege that Vargas tried to make his ex–girlfriend have a miscarriage by spiking her soda with labor inducing herbs.

While her baby was born healthy a few months later. The state is charging Vargas with attempted fetal homicide.

He faces a maximum penalty of 25 years in prison if he's found guilty.
