2 DUI convictions can't be used in tow truck trial

GILLETTE, Wyo. (AP) - Prosecutors won't be able to use a Gillette man's two previous driving under the influence convictions against him in a trial over the death of a tow-truck operator.

A district court judge on Wednesday ruled that the two previous cases are not admissible in Justin Helsper's upcoming vehicular homicide trial.

Investigators say he was nearly four times over the legal limit for driving when he struck and killed 65-year-old tow truck driver Larry Schofield along Interstate 90 in November.

County Attorney Jeani Stone declined to comment on how the decision will affect the case against Helsper.

Also Wednesday, the 28-year-old changed his plea to a drunken driving charge to no contest. He'll be sentenced for that charge in circuit court in July.
