The state and the defense attorney for a man charged with causing the death of another man in a motel parking lot are still at odds.
Charles Birds Head's attorney still doesn't think the state is complying with court orders. Prosecutors say they are not trying to hide evidence. They say they've complied with handing over autopsy reports and they're not hiding anything.
On Tuesday, Judge Wally Eklund ordered that state send DNA and evidence over to the state lab to be tested.
Birds Head, 30, is charged with felony manslaughter for the shooting death of Eustacio Maruffo, 33, at the South Dakota Rose Inn back in January.
Birds Head's next court appearance will be May 6th.
