Rapid City mother to stand trial for aggravated child abuse


A Rapid City mother charged with aggravated child abuse has been bound over for trial.

Angelita Elk Boy, 38, is charged with aggravated child abuse for allegedly leaving her 16 month year old child home alone last month where a fire started.

She is also charged with a fourth offense driving under the influence. A firefighter, police officer, and neighbor told their accounts of what happened.

Judge Heidi Linngren thought there was enough evidence to move forward.

Prosecutors say cases like this aren't uncommon.  "We see child abuse statutes, charges frequently, ones that are under the theory of exposing to harm, probably not as much as a straight up abuse or physical neglect type cases," said Deputy State's Attorney in Pennington County, Josh Hendrickson.

If convicted on both charges, Elk Boy faces a maximum of 20 years in prison.
