Investigation report claims officer was 'justified' in February shooting

'Justified' ... that's what the report says about the Rapid City police shooting of Elijah White Magpie Feb. 21.

Attorney General Marty Jackley and the Division of Criminal Investigation Thursday released the five-page summary into the shooting of White Magpie last month near the Rapid City Library.

Police had been called to the library after White Magpie was asked to leave the facility because he was creating a disturbance.  White Magpie then reportedly threw rocks, breaking library windows; as well as brandishing a knife.

"It is the conclusion of this report and the Attorney General that Officer Jerry Moore was justified in firing his weapon and using lethal force," stated Attorney General Jackley.  Moore shot White Magpie five times.

According to the report, the shooting was after White Magpie, seen on the patrol car's camera, charged Moore's patrol car and then turned on another another officer, Marc Black.  Black used a Taser on White Magpie who continued to advance and, the report stated, slashed at Black with a large butcher knife.
