Defense attorney's for a man charged with causing the death of another man during a drug deal gone wrong demand evidence from state prosecutors.
Charles Birdshead, 30, is charged with felony manslaughter for the shooting death of 33 year old Eustacio Maruffo at the South Dakota Rose Inn on January 7th.
Monday, a judge granted a defense request to have key evidence tested independently for blood and DNA analysis. The evidence comes from a 15 year old female, with whom Birdshead is alleged to have had a sexual relationship, according to state prosecutors.
The defense was also granted access to addresses, names and locations which had been redacted out of police reports.
State prosecutors called the request a 'fishing expedition' saying they believed witnesses may be threatened if their contact information was released.
