SD Attorney General requests October execution date

South Dakota's Attorney General is asking that 49-year-old Eric Robert be executed in October.

In a motion filed Friday, Marty Jackley requested that Robert die by lethal injection the week of October 14th. Jackley says that time period has been confirmed with the warden.

Robert pleaded guilty to killing prison guard Ron Johnson and was set to be executed in May. But the State Supreme Court had to conduct a mandatory review to make sure the sentence was proper. Last week, the high court gave the green light.

The date of the execution will be set by Judge Bradley Zell.

A second inmate involved in the escape attempt, 49-year-old Rodney Berget, also pleaded guilty and was sentenced to death.
