Attempted fetal homicide case on hold

He's accused of attempting to kill an unborn child. But for now, he will remain a free man.
 
Alfredo  Vargas, 34, is accused of drugging his girlfriend with labor inducing herbs, with the intent to kill her unborn child.

Judge Mary Thorstenson recently ruled that herbologist experts presented by the state lacked the credentials to testify about what drug Vargas tried to use. As part of the Judge's ruling, Vargas' wife will not be forced to testify against her husband about remarks he made about the incident.

State prosecutors dismissed charges against Vargas Monday, but they expect to see him in court again.
 
"The state is still confident in its case, it still feels it has a solid case. just needs to get one more piece in hopes to educate the jury with more clarity about what the substance was and what his plan was, " said Pennington county State's Attorney Scott Roetzel.
 
Judge Thorstenson also refused to allow testimony from a friend of Vargas', who claimed he offered her a labor inducing drug just a year before his girlfriend was allegedly drugged.
