19-year-old strikes deal in stray bullet case

A man who shot at a moving vehicle has made a plea agreement with the state.

Nineteen year old John Shaw of Box Elder could serve a maximum of 60 years in prison for firing at a car that was driving on Highway 16, south of Rapid City.

A Texas man was driving a rental car near Reptile Gardens when he heard a noise.  He discovered later that a bullet had gone through the passenger's door and lodged in the center console.

In a 7th Circuit Courtroom Friday, Pennington County Deputy State's Attorney Anthony Bolson promised to request no more than 50 years if Shaw pled guilty to one count of discharging a firearm at a motor vehicle and three counts of aggravated assault.

A host of other charges have been dropped due to the plea agreement.

While fighting with someone Shaw said he pulled out a hand gun, pointed it at a car driving down the road, and then fired. He also said he was drunk and using narcotics at the time and just wasn't himself.

A special hearing, where the victims can give their testimony, is scheduled for August 1st.
