Wyo. Supreme Court hears appeal in 2009 home invasion killing

Posted:

An attorney for a Sheridan teenager serving a life sentence urged the Wyoming Supreme Court Wednesday morning to find the teen's sentence unconstitutional.

Dharminder Vir Sen, along with two other teens was convicted of shooting and killing Robert Ernst in 2009.

At the beginning of the year, Sen's new lawyer challenged his life sentence, saying he could have been tried as a juvenile if he had had better representation.

Sen, who was 15 at the time of the crime, allegedly fired the shot that killed Ernst.

His lawyer says the life sentence for violates the Constitutional prohibition against cruel and unusual punishment.

The Supreme Court has already upheld the life sentences of the other two defendants.
