Lawsuit throws wrench into negotiations with the Black Hills Playhouse

Two weeks ago, the Black Hills Playhouse filed a lawsuit, suing the state for kicking them out of Custer State Park.

Now, Attorney General Marty Jackley is encouraging the two groups to negotiate a deal rather than taking it to court.

Playhouse board members want the same.

The Black Hills Playhouse lease ended in October, and the state said it wouldn't reinstate it until the playhouse made significant infrastructure upgrades.

Playhouse administrators said they can't afford those upgrades in the time frame the state requires.

If they can't work out a deal, Jackley said he will work to further the state's interests.

The governor's office refused to comment on the issues of negotiations with the playhouse.
