A former Pennington County prosecutor pled guilty Monday morning to felony drug charges. Toby Karn, 37, was arrested in September and charged with possession of a controlled substance (steroids) and conspiracy/distribution/possession with the intent to distribute marijuana.
In a sting, the Unified Narcotics Enforcement Team delivered three pounds of pot and two glass vials of anabolic steroids to Karn, and he accepted.
Each of the two counts carries a maximum sentence of 10 years in prison and 20-thousand dollars in fines. He will be sentenced in January.
Karn was a Deputy State's Attorney for Pennington County from May 2000 to December 2002.
Karn's attorney John Murphy released the following statement on his client's behalf:
Toby is a good man and a great father. He got involved in a situation that is inexplicable. He is trying to make the situation right: he waived his preliminary hearing, his right to trial and his right to remain silent, and has entered guilty pleas to both counts. He is not going to contest the case or protract the litigation. He looks forward to trying to put this matter behind him for his family's sake.
