PIERRE, S.D. (AP) _ A split South Dakota Supreme Court says a $33,000 loan from one Sioux Falls man to another does not have to be repaid under a state law that voids loans involving gambling debts.
Donald Davis loaned Gerald Neve money in 1993 because Neve was having financial problems. Neve later asked a judge to declare the promissory note void because part of the consideration was to repay a $1,500 gambling debt he owed Davis.
A jury found that the loan was made in partial consideration of a gambling debt, which made the loan void. The trial judge later ruled that the loan could be enforced because there was not enough evidence to support the jury verdict.
But in a 3-2 ruling, the Supreme Court reinstated the jury's verdict to void the loan.
